TERMS OF SERVICE

OVERVIEW

Welcome to Evenlyr. These Terms of Service (“Terms”) govern your access to and use of evenlyr.shop, including its content, products, features, tools and related services (collectively, the “Services”).

The terms “Evenlyr,” “we,” “us” and “our” refer to Evenlyr, operated by Ahmed Refaat Tolba Tohamy Ismail, Via Pisa 179/15, 20099 Sesto San Giovanni (MI), Italy.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services.

By accessing our website, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping & Delivery Policy. If you do not agree, you must not use the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your country, state or province of residence to use the Services or place an order.

You agree to provide accurate, current and complete account, billing, payment and delivery information. You are responsible for protecting your account credentials and for activity performed through your account.

You must notify us promptly at astrame87@gmail.com if you believe that your account has been accessed without authorization.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

Evenlyr sells indoor and outdoor lighting products, including pendant lights, chandeliers, wall lights, table lamps, floor lamps, outdoor fixtures and related accessories.

We make reasonable efforts to ensure that product descriptions, measurements, materials, finishes, photographs and specifications are accurate. However, colors and appearance may vary slightly because of screen settings, lighting conditions, photography and natural variations in materials.

Natural stone, marble, travertine, alabaster, wood and similar materials may display variations in color, texture, veining or pattern. These natural variations are not necessarily defects.

Product dimensions and technical specifications should be reviewed carefully before ordering. We may update product information, availability or specifications when necessary. If a change materially affects an order already accepted, we will notify the customer and provide an appropriate solution where required by law.

SECTION 3 — ELECTRICAL PRODUCTS AND INSTALLATION

Before purchasing an electrical product, you are responsible for checking that its dimensions, voltage, plug type, installation requirements and intended use are compatible with your location.

Hardwired lighting products must be installed by a qualified and appropriately licensed electrician in accordance with the instructions supplied with the product and all applicable electrical and building regulations.

Products must not be modified or used outdoors unless the applicable product page expressly identifies them as suitable for outdoor use.

Nothing in this section limits any mandatory product safety rights or statutory warranties available to customers.

SECTION 4 — ORDERS

Submitting an order constitutes an offer to purchase. An order is accepted only when we send confirmation that the order has been accepted or dispatched.

We may decline or cancel an order for legitimate reasons, including suspected fraud, incorrect pricing, payment failure, product unavailability, delivery restrictions or an obvious error in the product information.

If we cancel an order after payment has been collected, we will refund the relevant amount to the original payment method.

Please review your order carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible at astrame87@gmail.com. We cannot guarantee that an order can be changed after processing has begun.

SECTION 5 — PRICES, CURRENCY AND PAYMENT

Product prices are displayed in the currency selected for the applicable market. Customers purchasing through the United States market are shown prices in United States dollars unless otherwise indicated.

Shipping charges and any applicable taxes are displayed during checkout before the order is submitted.

You agree to provide valid and accurate payment information and confirm that you are authorized to use the selected payment method.

Prices, promotions and discounts may change without notice, but changes will not affect orders already accepted. Promotional offers may be subject to separate conditions.

SECTION 6 — SHIPPING AND DELIVERY

Evenlyr currently accepts orders for delivery to the United States, Australia, Canada, Ireland, New Zealand, Singapore, South Africa and the United Kingdom. Destination availability is confirmed at checkout.

Orders to eligible United States destinations are offered tracked delivery with an estimated total delivery timeframe of 2–10 business days after order confirmation.

• Orders from $0.01 to $99.99 USD: $19.99 USD tracked shipping.

• Orders of $100.00 USD or more: free tracked shipping.

Orders to Australia, Canada, Ireland, New Zealand, Singapore, South Africa and the United Kingdom have an estimated total delivery timeframe of 5–15 business days after order confirmation. Standard tracked shipping costs €19.99 EUR. For markets using another currency, Shopify converts the charge and displays the final amount in the customer’s local currency at checkout before payment.

Delivery timeframes are estimates and may be affected by carrier disruption, customs processing, severe weather, incorrect delivery information or other circumstances outside our reasonable control. We will communicate material delays when we become aware of them.

Evenlyr works with third-party suppliers and logistics partners. Products may therefore be fulfilled and shipped directly by a third-party partner from a location outside the customer’s country.

Internationally fulfilled products may be subject to customs processing. Shipping charges and any taxes, duties or import charges collected by us are displayed at checkout. Charges imposed separately by a destination authority or carrier remain the customer’s responsibility unless applicable law requires otherwise.

SECTION 7 — RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, damaged products and cancellations are governed by our Refund Policy:

Customers must contact us before returning a product. Products returned without authorization or to an address not provided by Evenlyr may not be accepted.

Return requests generally must be submitted within 30 days of delivery, subject to the eligibility requirements, exclusions and instructions stated in the Refund Policy.

Nothing in these Terms limits any mandatory rights available under applicable consumer protection law.

SECTION 8 — BUSINESS AND COMMERCIAL ORDERS

Evenlyr may accept orders from businesses, interior designers, restaurants, hotels and hospitality customers.

Commercial customers are responsible for verifying product suitability, electrical compatibility, installation requirements and project measurements before placing an order.

Products may not be resold using Evenlyr branding, photographs or intellectual property without our prior written authorization.

SECTION 9 — ACCURACY, AVAILABILITY AND ERRORS

Occasionally, information on the website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery times or availability.

We reserve the right to correct genuine errors and update inaccurate information. If an error materially affects an order that you have already placed, we will contact you and provide an appropriate solution, including cancellation and refund where applicable.

SECTION 10 — INTELLECTUAL PROPERTY

The Evenlyr name, branding, website design, written content, graphics, photographs, videos, logos and other original material made available through the Services are owned by or licensed to Evenlyr and are protected by applicable intellectual property laws.

You may use the website only for lawful personal or internal business purposes. You must not reproduce, distribute, republish, sell, modify or commercially exploit our content without prior written authorization.

Third-party trademarks and content remain the property of their respective owners.

SECTION 11 — REVIEWS AND FEEDBACK

If you submit a review, image, suggestion or other feedback, you confirm that the content is accurate, lawful and does not violate another person’s rights.

You grant Evenlyr a non-exclusive, worldwide, royalty-free right to use, reproduce and display submitted feedback for operating and promoting the Services.

We may remove content that is fraudulent, unlawful, offensive, misleading, unrelated to the product or in violation of these Terms.

SECTION 12 — THIRD-PARTY SERVICES AND LINKS

The Services may include tools, payment services, applications or links operated by third parties.

We are not responsible for third-party websites or services that we do not control. Before using a third-party service, you should review its applicable terms and privacy practices.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify. Purchases made through evenlyr.shop are transactions directly between the customer and Evenlyr.

Shopify provides the ecommerce platform but is not the seller of Evenlyr products and is not responsible for fulfilling orders, processing returns or resolving product-related claims.

SECTION 14 — PRIVACY

Personal information collected through the Services is processed in accordance with our Privacy Policy:

Because our store is hosted by Shopify, certain information is also processed by Shopify and by service providers used to operate the store, process payments, prevent fraud and fulfil orders.

SECTION 15 — PROHIBITED USES

You must not use the Services:

• For any unlawful, fraudulent or malicious purpose.

• To infringe intellectual property, privacy or other legal rights.

• To submit false or misleading information.

• To distribute malware, spam or harmful code.

• To interfere with the security or operation of the website.

• To access another customer’s account without authorization.

• To scrape, copy or commercially exploit website content without authorization.

• To circumvent security, fraud-prevention or access-control measures.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

SECTION 16 — DISCLAIMER OF WARRANTIES

We aim to provide accurate information and reliable Services. However, except for warranties and rights that cannot legally be excluded, the Services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted or free from technical errors.

Nothing in these Terms excludes statutory warranties, product conformity rights or other mandatory consumer protections.

SECTION 17 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Evenlyr is not liable for indirect or consequential losses that were not reasonably foreseeable when an order was placed.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by negligence, mandatory product liability or statutory consumer rights.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to compensate Evenlyr for reasonable losses or claims resulting directly from your unlawful use of the Services, your material breach of these Terms or your violation of another person’s rights.

This section does not apply where the loss or claim was caused by Evenlyr or where liability cannot legally be transferred to the customer.

SECTION 19 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to the Services if you materially violate these Terms, engage in fraudulent activity or misuse the website.

Termination does not affect rights or obligations that arose before termination, including outstanding payment, refund or warranty obligations.

SECTION 20 — SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be applied to the greatest extent permitted by law or removed where necessary. The remaining provisions will remain effective.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

A failure to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with the policies referenced in them, constitute the agreement governing use of the Services and purchases made through the store.

SECTION 22 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights and obligations as part of a legitimate transfer, reorganization or sale of the business, provided that this does not reduce customers’ mandatory legal rights.

SECTION 23 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Italy.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the laws of your country or state of residence.

Any dispute will be handled by the courts having jurisdiction under applicable law. Before beginning formal proceedings, customers are encouraged to contact us so that we can attempt to resolve the matter directly.

SECTION 24 — CHANGES TO THESE TERMS

We may update these Terms when required to reflect changes to our Services, business practices or applicable law.

The latest version will be published on this page with an updated revision date. Material changes will apply prospectively and will not reduce rights already acquired under an accepted order.
